In accordance with sub-section (1) of section 24 of the Limited Liability Partnership Act, 2008:
"A person may cease to be a partner of a limited liability partnership in accordance with an agreement with the other partners or, in the absence of agreement with the other partners as to cessation of being a partner, by giving a notice in writing of not less than thirty days to the other partners of his intention to resign as partner."
Form 13 (Specimen of notice of cessation by a ceasing partner to other partners) is prescribed under the Limited Liability Partnership Rules, 2009. (See the screenshot from the rules below for Form 13)
A designated partner, of a Limited Liability Partnership (LLP) company, who wants to resign from his position in LLP, should write a resignation letter only in the format prescribed under the law i.e. Form 13.
Check the MCA site for any further modifications to the Form 13.
A copy of the signed Form 13 submitted by the designated partner serves as an "Evidence of cessation" from his position in the LLP and is to be attached to e-Form 4 or 4A for submission at MCA portal to intimate the event to the concerned Registrar of Companies (ROC).

ReplyDeleteIf the date of agreement for retirement is 23rd Oct 2018 then Date of Form 13 would be between 24th Sept to 22nd Oct 2018... Right? ..... As My form 4 is sent for re-submission saying Date of Form 13 is not correct (As we have mentioned date of form 13 is 31.07.2018 and Agreement date is on 23rd Oct 2018.
